Actress Sukanya's Divorce Petition In The Family Court


Actress Sukanya ,who acted in "Peddarikam" movie in Tollywood opposite to Jagapathi Babu, married American Indian Sridharan at the Balaji Temple in New Jersey in 2002. The very next year, the actress returned to her residence in Chennai and decided to stay back and concentrate in acting career.

When Her husband sent her letters from California asking her to come back again. Sukanya refused. Following this, the actress filed a divorce petition in the family court in Chennai and without her husband’s knowledge she obtained the divorce.

When Sridharan came to know of this, he filed a writ petition in the High Court of Madras that the divorce obtained in Chennai is not binding on him as the marriage had taken place in the US and hence the court here had no jurisdiction.

In an order passed in this issue, The Madras HC has held that a woman can file a divorce petition under the Hindu Marriage Act Section 13 in any part of the country, wherever she resides, even if her husband is a foreign national having his domicile outside India, since their wedding took place as per the Hindu norms and customs. The judge further ruled that the issue be settled within two months.
